Malaysia: Blogger vows to die in silence if re-arrested

Kuala Lumpur, 16 Feb. (AKI) - Rebel blogger Raja Petra Kamarudin has vowed to die in silence as a sign of protest if he is re-arrested on what many believe are politically motivated grounds. His pledge came as a court was due to rule whether he is to return to prison under Malaysia's Internal Security Act (ISA), Raja Petra, who has risen to prominence as a pro-opposition blogger, was arrested on 12 September after accusations lodged by several religious groups who claim that he offended Islam in an article published on 8 August.
He was released on 7 November last year but the government has appealed the court decision and a verdict is expected on Tuesday. “I shall no longer open my mouth or utter one word during my detention. I shall maintain the silence of a mute person. I shall not sign any documents of the so many documents that they make you sign when under detention," he said."My signature is not going to be placed on a single shred of paper,” he wrote in his blog, ‘Malaysia Today’ acknowledging that the move could have dire consequences. ”I shall refuse all medical treatment and visits to the hospital. I shall refuse to accept any food and water supplied by the authorities. "I shall refuse to leave my cell or to meet any of the prison authorities.
In short, I shall shut myself out from the world and keep to my own world of my eight feet square cell.“This action will mean I shall survive at the most seven to eight days,” he added. Raja Petra blamed deputy prime minister Najib Razaq for his arrest and for what he calls his political persecution. Najib has been among Raja Petra’s main targets in his blog.In his most controversial article “Let’s Send Altantuya’s Murderers to Hell”, published on 25 April, Raja Petra said that Najib and his wife, Rosmah Mansoro, were involved in the killing of Altantuya Shaariibuu.
Translator and former model, the Mongolia-born Shaariibuu, 28, was shot twice in the head, and her body was blown up with explosives, in a jungle outside Kuala Lumpur in October, 2006.“I am totally sure that Najib (Razaq) is involved. And at the very least, he should be investigated,” Raja Petra told Adnkronos International (AKI). ““I am aware that I have raised the stakes with this article and I am prepared to go all the way,” he added.Najib has denied any involvement in the case and has sworn on the Koran that he never met Shaariibuu. He has also denied any involvement in the arrest of Raja Petra.
The ISA was inherited by Malaysia after it gained independence from Britain in 1957. In essence, it allows for the arrest of any person without the need for trial in certain circumstances.

April elections to test Malaysia PM’s popularity

KUALA LUMPUR: Malaysia’s incoming prime minister will face his first referendum in two simultaneous by-elections just days after taking office in early April. The polls, to be held a month after the government’s rollout of a second stimulus package, will also gauge public acceptance of Najib Razak’s management of a country whose exports are tumbling and whose economy looks set to slide into its first likely recession in eight years.

The outcome of the votes will not alter the national political power balance, but opposition victory will keep Anwar Ibrahim and his alliance on track as contenders to win power in the next general elections due by 2013. Anwar’s People’s Alliance won control of five of Malaysia’s 13 states and denied the government its iron-clad two-thirds parliament majority in last year’s general elections.

It has also won two by-elections in the last six months, but suffered a recent setback after losing control of the state of Perak in a political coup by the National Front. “Whether intended or not, the timing of the two polls means it will be seen as referendum on Najib as Prime Minister,” said Ibrahim Suffian, director of respected opinion pollster the Merdeka Center for Opinion Research.

The by-elections, called after the death of an MP in Perak and the resignation of a state lawmaker in neighbouring Kedah state, will be held simultaneously on April 7, the Election Commission announced yesterday.
The polls are a just week after Najib takes office as Malaysia’s sixth Prime Minister with poll ratings that stand at 41 percent versus 46 percent for incumbent Abdullah Ahmad Badawi.
That the polls will happen only after Najib’s United Malays National Organisation (UMNO) party completes internal elections where Najib stands unopposed as party president, will allow the party to close ranks before heading for the vote.

The Democratic Action Party (DAP). one of three members of the People’s Alliance, accused the Election Commission of giving UMNO, the lead component in the National Front, an unfair advantage. “The fractious and internecine UMNO party elections until March 28 had been the primary consideration of the Election Commission ... so that the campaign will be held after the UMNO elections and Najib has become the Prime Minister,” said DAP parliamentary leader Lim Kit Siang.

Observers are keenly watching how voters will take to the second stimulus package that Najib, who is also finance minister, will table in parliament on March 10.
Najib has not revealed any details about the spending plans beyond the fact that it will be larger than the 7bn Malaysian ringgit ($1.94bn) stimulus announced in November.

Najib on Thursday announced a 21 million ringgit allocation from the second stimulus package would be given to mission schools in the eastern states of Sabah and Sarawak, where Anwar has been trying to make inroads.
Campaigning will be especially intense for the Bukit Gantang parliament seat in Perak, where public anger over the coup against the Pakatan Rakyat remains high.

UPR-Press Statement

Human Rights Council– Universal Periodic Review11 February 2009 (afternoon) For use of information media; not an official record · Rights Council's Universal Periodic Review Working Group reviewed the fulfillment of human rights obligations by Malaysia this afternoon, during which 60 Council members and observers raised a number of issues pertaining to the human rights situation in the country.·

This afternoon, the Working Group also adopted, ad referendum, the report on Nigeria, following the review of the country on Monday, 9 February. · Presenting the national report of Malaysia was TAN SRI RASTAM MOHAMAD ISA, Secretary-General in the Ministry of Foreign Affairs of Malaysia, who noted that the respect for human rights in Malaysia has been established taking into account the country's character as a melting pot of various cultures, religions and ethnicities. History has shown that in Malaysia, the people have always held values of tolerance, harmony and mutual respect in the highest regard.

However, the onset of colonialism brought with it the unfortunate practice of associating ethnicity with particular economic activities. Today, Malaysia was a robust democracy and was steadily charting a course towards achieving developed status. Malaysia's efforts to secure the promotion and protection of human rights and fundamental freedoms for its people have been very much focused on achieving inter-racial harmony within the society, coupled with equitable socio-economic development while taking into account the human rights and fundamental freedoms of the individual. The basis for the promotion and protection of human rights in Malaysia was enshrined in the Federal Constitution which remained the primary source of law in Malaysia. Malaysia believed in the importance of poverty eradication as a major effort for promoting and protecting human rights. For the past 35 years, Malaysia's poverty rates have declined dramatically. Since the early 1970s, Malaysia has reduced poverty among nearly half of the population (49.6 per cent) through the implementation of various specific poverty eradication programmes.

To improve the quality of life and well being of the Malaysian population, the Government placed great emphasis in providing adequate, affordable and quality housing for the people.Responding to questions submitted ahead of the review, the head of delegation noted that in an effort to further improve its human rights obligations, Malaysia set up an Inter-Agency Coordinating Committee chaired by the Ministry of Foreign Affairs. The Committee has been active in deliberating on issues relating to human rights treaties and other international instruments, including the Rome Statute. The Coordinating Committee was established in the year 2000 and has the mandate to study and recommend Malaysia's accession to human rights treaties and compliance with treaties which Malaysia are a party to.

On the issues of Special Procedures, Malaysia will remain open to the possibility of further discussions with the various Special Procedures on the proposed visits and was willing to consider such requests positively on the merit of each proposal. As to refugees and asylum seekers, Malaysia was not a party to the 1951 Convention Relating to the Status of Refugees and its 1967 Protocol Relating to the Status of Refugees. Notwithstanding this, Malaysia has complied with its international obligations to persons who have entered Malaysia claiming to be refugees and asylum seekers through special arrangements on humanitarian grounds. Malaysia adopted close cooperation and constructive engagement with UNHCR and has taken a flexible attitude, specifically by not prosecuting UNHCR card holders in court for their illegal stay.On the issue of foreign workers, Malaysian laws provided adequate and reasonable legal protection to all foreign workers. Malaysia dealt with the flow of foreign workers on a bilateral basis with sending countries by executing legally binding instruments to regulate the entry and exit of foreign workers to Malaysia.

The Government gave very serious attention to the issue of foreign workers which was evidenced by the establishment of the Cabinet Committee on Foreign Workers and Immigrants chaired by the Deputy Prime Minister. On the Human Rights Commission of Malaysia (SUHAKAM), the Commission was entrusted with the power to inquire into complaints relating to the infringement of human rights and was also mandated to promote awareness of human rights through education. Several measures were being taken by the Government to ensure that SUHAKAM retained its status as a credible and respected national human rights institution. On the issue of the independence of the Judiciary, the speaker noted that the Judicial Appointments Commission (JAC), which was established on the principles of transparency and accountability, was entrusted with the core responsibility of identifying and recommending suitable candidates for judicial appointment and promotion based on clearly defined criteria.

To deal with cases of corruption, it was noted, in response to another question, that the Malaysia Anti-Corruption Commission (MACC) was established to enhance the effectiveness and efficiency of anti-corruption efforts as well as to increase public confidence in the independence and transparency of the Commission.· During the three-hour interactive discussion delegations noted a number of positive achievements of the State under review.
These included the active role played by Malaysia in ASEAN in the field of human rights;
gains made in eradicating poverty over the years; increased economic prosperity and economic stability;
advancements made in the field of education and the creation of the Education Development Master Plan;

measures to combat violence against women and protect victims; efforts in working towards gender equality and advancing the status of women;

the progress achieved in the Education Development Master Plan;

These included: To continue to spearhead progress towards gender equality and development for women; to step up efforts to enhance women's participation at the decision-making level; to strengthen efforts to combat all acts of violence against women trafficking in women; to provide victims of domestic violence with access to legal remedies and bring perpetrators to justice; to develop and adopt national legislation and practices granting formerly trafficked and exploited women and children; to explore further ways and means aimed at improving and enhancing the welfare and protection of victims of child abuse; to withdraw reservations made to the Convention on the Rights of the Child; to continue to cater to children with special needs; to pay special attention to the problems of children living and working in the streets; to outlaw corporal punishment; and to ratify the Convention on the Elimination of Discrimination Against Women and its Optional Protocol.

TBRA MEMBERS NEEDS SUPPORTERS

Dear TBRA members,

hope you all enjoyed a Happy Chinese New Year. Even before the horrific landslide in Taman Antarabangsa, the residents of Chee Seng Gardens in Tanjong Bunga confronted the developers of a hillside construction project about an "accident waiting to happen". A stop-work order was slapped on the construction site demanding that more retention ponds be built to avoid the floods that had frightened residents. Another stop-work order came later.

But after 2 weeks, such stop-work orders are lifted once the developers have complied. However, the steep hillside (over 35 degrees) still has plenty dangers: huge boulders need to be blasted, erosion is on-going and the walls between the construction site and the neighboring condos are far to thin to provide any real protection against landslides. More letters were sent and meetings with local authorities took place. But the blasting and digging goes on. Several joint meetings of the condo residents associations, and the Chee Seng residents, supported by TBRA, have now decided to launch a massive but peaceful no-confidence protest.

We call it a Tea Party and it will take place on:

14 Febr 2009 (YES, on Valentine’s Day) from 4 to 5 pm at the top of Jalan Chan Siew Teong in Chee Seng Gardens*

We need you to be there in solidarity. Only if hundreds of residents turn up, will the authorities pay attention. This is no longer a local issue, it is an opportunity to tell the new Penang government that the residents are fed up with dangerous hill slope development, that Tanjong Bunga has had enough high rises, enough deforestation, enough erosion. We don't want any new construction on Class III (25-35 degrees) and Class IV (above 35 degrees) slopes. At the meeting with the Chief Minister on 21 December he seemed to agree with our demands but was hiding behind the decisions of the Old government and the fear to be sued. He announced the setting up of some kind of Authority to keep and eye on hillside hazards. Unless we show him that we mean business, matters may comfortably slip back onto the back burner with State and the MPPP closing their eyes and allowing developers to carry on.

We want commitments in writing, we want a clear ban on Class III & IV hill slopes, we want existing developments to stop unless they are proven safe (by independent engineers) and there is assurance that safety of exposed slopes is monitored by a highly competent hill slope committee also after the projects are finished.

So come join us at this Tea Party

with banners and posters, with tea kettles (or old pots and pans) and bring wooden spoons…. (Why? You’ll see !) Let the few unspoilt hills be your Valentines for an hour on that day. * Enter Chee Seng from Tanjong Bunga village and drive uphill or take the road leading uphill opposite the floating Mosque. Come in jogging gear. Press has been invited. There is plenty of parking space.

PAS dan PKR kecam tindakan rampas Harakah dan Suara Keadilan

Wed Feb 11, 09 12:23:55

Kedah Sultan wants to know if Arumugam was forced to quit

The Kedah Sultan is looking for former assemblyman, V. Arumugam, who has gone missing. -The Star/ANN

By SIRA HABIBU

ALOR STAR, MALAYSIA: Many people, including the Kedah Sultan, are looking for former Bukit Selambau assemblyman V. Arumugam who has gone missing since Feb 4.

The Kedah Sultan's confidential secretary Datuk Wira Syed Unan Mashri Syed Abdullah said the Sultan had asked his office to summon Arumugam to the palace following speculation that the elected representative wanted to quit both the State Exco post and Bukit Selambau state seat.

"We were unable to contact him. However, we received Arumugam's letter stating his intention to quit," he said.

It is learnt that the Sultan wanted to hear from Arumugam if he had been coerced into making the decision to vacate the state seat.
Arumugam is believed to have flown to Chennai, India, on Monday night after purportedly signing the letter of resignation and a statutory declaration to vacate both the executive council and state assembly posts.

A middleman sent the letter and statutory declaration to Speaker Datuk Dr Abdul Isa Ismail at 5pm on Monday.

In the statutory declaration, Arumugam, who joined PKR after winning the seat in the March 8 general election, purportedly stated that he was quitting the posts because he was being harassed by Barisan Nasional members who wanted him to leave Pakatan Rakyat.
Arumugam's disappearance has fuelled speculation that he was forced to vacate his Bukit Selambau state seat.

Kedah Mentri Besar Datuk Seri Azizan Abdul Razak was also unable to contact Arumugam.
However, Kedah Pakatan Rakyat chief Ahmad Kasim said Arumugam was on vacation overseas after his alleged scandal became public knowledge.

"He (Arumugam) is feeling stressed," he said yesterday.

Former Merbok PKR strategy director Zamil Ibrahim alleged that PKR de facto leader Datuk Seri Anwar Ibrahim was hiding Arumugam. Zamil, who introduced Arumugam to the political arena, resigned from PKR in August last year.

The only moral thing to do is to dissolve the Perak State Assembly

Wednesday, 04 February 2009 19:30

Aliran is alarmed that the duly elected legitimate government in Perak is being toppled through immoral party hopping thus frustrating the will of the people.
These party hoppers do not represent themselves but they are the representatives of the people. In the last election, these individuals were not elected solely on their individual merit. But the votes were mainly cast for the Pakatan Rakyat in rejecting the BN.

If people had chosen to cast their votes on the merit and qualification of candidates, many of them would not have been elected. It is very clear the votes were meant for the party. These individuals have no right to now nullify the electoral process,It would only be morally right that the state assembly be dissolved and fresh elections be held. Let the people decide who should form the government.

An alternative government should not be allowed to emerge through defections under such questionable and dubious circumstances without seeking a fresh mandate from the people in line with their aspirations.

MAJLIS “KEMATIAN DEMOKRASI” MENGIRINGI KEHADIRAN MB BARU

RAKYAT PERAK BANGUN MEMBANTAH

TEMAN NAK SALAH FRU PUN IDAK.KOJE YOP.NAK SALAH DEME PUN UDAH UNDANG-UNDANG GITU.

Key Malaysia party backs Anwar as leader

KUALA LUMPUR: A key Malaysian opposition party said yesterday it continued to support Anwar Ibrahim as the leader of a three-party alliance following calls for him to step down.
Anwar, 61, the country’s former deputy premier, was asked to step down on Sunday by the chairman of the Democratic Action Party (DAP) after the opposition lost control of one of the five states it rules to the national government.
“In this regard the DAP supports ... Anwar Ibrahim as the parliamentary opposition leader and will remain so as no single leader has ever questioned this during internal meetings whether at the highest levels or otherwise,” DAP Secretary General Lim Guan Eng said in a statement.
The Chinese-dominated DAP is the second largest of the three unwieldy parties in Anwar’s People’s Alliance that also comprises an Islamist party and the multi-ethnic People’s Justice Party. The apparent rift in the DAP leadership.

But while the National Front now has a majority in the state assembly after the defections, the chief minister of tin-rich Perak from the People’s Alliance has defied Sultan Raja Azlan Shah’s order to vacate the statehouse, throwing Malaysian politics into further turmoil. The Sultan was due to swear-in a new chief minister from the National Front on Friday.

Malaysia has nine sultans who are titular rulers of their states and take turns being the country’s constitutional king under a rotating monarchy.

The apparent rift in the DAP leadership comes amid talk that the National Front is looking next to toppling opposition-ruled Kedah state. And with Anwar threatening a series of rallies to stir his legions into action, the political uncertainties that have beset Malaysia since elections nearly a year ago seem set to continue.

Malaysia government faces by-elections amid anger

The Associated Press

Published: February 10, 2009

KUALA LUMPUR, Malaysia: Malaysia's ruling coalition braced Tuesday for unexpected elections for two legislative seats that could see it chastened by voters following its contentious takeover of an opposition-led state.

The special ballots will be viewed as a public referendum on tactics used by Malaysia's Deputy Prime Minister Najib Razak — scheduled to take over as prime minister in March — and his National Front coalition to take over the administration of northern Perak state last week.
The Election Commission has to hold the by-elections within 60 days after an opposition member of Parliament in Perak died of a heart attack Monday and an opposition state lawmaker in neighboring Kedah resigned amid personal problems.

Neither election would cause a shift in power, but the Perak ballot in particular "will be a difficult by-election for (the ruling coalition) to go into in the midst of high emotions and anger running in Perak," political analyst Khoo Kay Peng wrote in a commentary.

Perak was one of five states won by opposition leader Anwar Ibrahim's three-party alliance in national polls last March, when the National Front suffered its worst electoral losses in more than 51 years of uninterrupted rule.

The National Front recaptured control of Perak after several opposition lawmakers switched allegiances.

Opposition parties decried the takeover as illegal and pledged to challenge it in court after Perak's royal ruler rejected their demand for fresh statewide elections.
Najib will face intense pressure to win the upcoming by-elections to prove he can shore up the National Front's ebbing popularity following two consecutive losses in similar ballots over the past six months.

PULUHAN RIBU HADIR CERAMAH PERDANA

PAKATAN RAKYAT SOKONG NIZAR,MOHON JUMPA PADUKA TUANKU RAYU ADAKAN PILIHANRAYA

Sepatutnya Suruhanjaya BPR siasat dulu kemana hilang mereka selama seminggu.
