Anwar trial another black eye for Malaysia-ANIL NETTO

PENANG - Malaysia's charismatic opposition leader Anwar Ibrahim is in the dock again on sodomy charges in a suit that threatens to reverse the startling revival in his political career.

"Sodomy II Starts", trumpeted the headline of the English-daily government-linked Star newspaper on Wednesday - heralding the beginning of another season in which a litany of explicit terms from court proceedings will be reported in the media.

On Wednesday, key prosecution witness Saiful Bukhari, a former junior Anwar aide, startled the court when he testified that Anwar had asked him "Can I f*** you?" when they were alone in a










condominium. Saiful, 25, said he was afraid when Anwar, 62, allegedly approached him.

Anwar has maintained his innocence and claimed the trial is part of a political conspiracy. He intends in his defense to subpoena Prime Minister Najib Razak and his wife Rosmah, who he claims both met with Saiful a couple of days before the latter submitted a police report about the alleged sodomy. They have both vigorously denied a meeting took place.

Anwar, once the heir apparent to former premier Mahathir Mohamad and now the leader of a resurgent opposition coalition, spent six years in prison from 1998.

At the height of the 1997-98 Asian financial crisis, and after falling out with Mahathir, he was arrested and severely beaten by the country's top police officer. A year later, he was sentenced to prison for corruption and in the following year, he was convicted of sodomy. Both convictions added up to a jail stint of 15 years.

His now famous black eye and jailing became the rallying point of the reformasi movement. In those tumultuous years, the democratic aspirations of political parties and civil society groups were intricately interwoven with Anwar's plight. Behind bars, he inspired a new political party, the People's Justice Party (PKR), led then by his wife, Wan Azizah.

In 2004, his sodomy conviction was overturned and Anwar was released - but barred from contesting elections until 2008. A general election was held just before he became eligible to run, though he played an instrumental role in the PKR's campaign.

His efforts steered a loose opposition electoral pact to a stunning performance, capturing five out of 13 states and denying the ruling Barisan Nasional (BN) coalition its coveted two-thirds parliamentary majority.

Anwar promptly won a by-election and has since become the standard bearer of the fledgling opposition coalition, now known as Pakatan Rakyat (People's Alliance). The alliance brought together the PKR, the Islamic party PAS and the Democratic Action Party.
Testing times
The second sodomy trial comes at a testing time for both the premier and Anwar. Since taking office last April, Najib has promoted his "One Malaysia, People First, Performance Now" slogan to foster national unity. Urbane and articulate, the premier hopes to regain lost ground after BN parties representing minority ethnic groups were routed in the 2008 election.

But his efforts have been undermined by recent controversies, including the uproar over a High Court decision in late December that granted a Catholic weekly newspaper the right to use the term Allah in its publications. The decision was followed by a spate of arson attempts or desecration of 18 Christian, Muslim and Sikh religious sites. This week a special aide to Najib resigned after reports alleged he made derogatory and racist remarks against ethnic minorities.

The Anwar trial and the Allah controversy have distracted media attention from other simmering scandals, including the theft of two jet engines from the air force, financial losses surrounding the construction of the Port Klang Free Zone project and the BN's takeover of the Perak state government last year following controversial defections.

Anwar's coalition, too, faces problems of its own. A conservative Muslim PKR parliamentarian has broken ranks with the party's moderate stand on the Allah issue. Outspoken from PKR federal parliamentarians have also spoken out against the DAP-led state government in Penang. It is uncertain whether they might lead a few more disgruntled parliamentarians and become "BN-friendly'' independents.

To many observers it is not just Anwar now on trial, but the integrity of the judiciary and police. The black eye inflicted on Anwar and the perceived misconduct of the court proceedings in his first sodomy trial greatly eroded confidence in the judiciary and the police as impartial actors.

Bowing to calls for reforms, Mahathir's hand-picked successor, Abdullah Badawi, set up two royal commissions of inquiry - one to look into the management of the police and the other to make recommendations on judicial appointments. Though they produced some positive recommendations, few would say the image of the police and the judiciary has since dramatically improved.

Meanwhile, much has changed since Anwar's first trial. During the last trial, websites were just emerging. Now, every detail of the court proceedings is available for a more skeptical and informed public to follow on social-networking sites, blogs, independent news portals, text messages, and the government-controlled media.

Arguably, the shifting patterns of news consumption were evident in the aftermath of the attacks on religious sites. Many had initially feared the incidents could spark race-based turmoil, but most Malaysians they did not fall for the bait, sensing that these were precisely aimed to provoke them.

Changed political alignments have also helped to defuse tension. Unlike before, Malaysia has a viable political opposition coalition that has a sizeable Malay-Muslim presence, making it a harder to sell issues along racial-religious lines. For instance, PAS and PKR have adopted a more conciliatory approach towards non-Muslim usage of the term Allah - provided the term is not abused.

BN supporters may be hoping the trial will convince more Malay-Muslim politicians to cross over to their side. But the danger of a backlash is there: if Anwar is once again seen as being victimized, he could become a rallying point for the Pakatan Rakyat, reuniting the parties in the alliance and encouraging more young people to register as voters.

That could prove as disastrous for the BN in the next general election as in the 1999 vote after Anwar was first arrested, humiliated and imprisoned. The present trial may drag on for months, with a series of appeals and counter-appeals likely to turn proceedings into a high stake soap opera.

That could cost the country at a time it faces many urgent economic and social issues, not least how to revitalize the economy and devise new strategies for sustainable development in view of depleting petroleum reserves. Government plans to impose a new value-added tax to make up for revenue shortfalls is bound to be met with strong opposition.

At the same time, there is also a sense that Pakatan Rakyat, now helming four state governments, has emerged as a viable coalition with a common framework that could survive even without Anwar. The risk is that without a charismatic leader in his mould, it would be much harder to paper over emerging cracks and hold the disparate parties in the coalition together.

At the end of the day, much will depend on how a more discerning Malaysian public view and respond to the unfolding saga.

Fitnah II : Rakaman CCTV Saiful Ditayang

KUALA LUMPUR : Kira-kira jam 3.43 petang, pendakwa mula memainkan video rakaman CCTV yang dirakam dipintu masuk kondominium pada 26 Jun 2008.

Saiful dalam kenyataannya mengesahkan bahawa lelaki di dalam video rakaman CCTV itu adalah dirinya yang sedang menuju ke Aras 5 pada hari kejadian liwat didakwa berlaku.
Kira-kira jam 3.55 Pendakwa Yusof cuba untuk menunjukkan rakaman CCTV dimana Saiful memasuki dan meninggalkan premis dengan keretanya tetapi komputer meghadapi masalah secara tiba-tiba.

Saiful yang memberi kenyataan pada jam 4.05 berkata selepas 2 hari kejadian itu berlaku, dia telah ergi ke 2 buah hospital sebelum ke hospital Kuala Lumpur (HKL).

KUALA LUMPUR 4 Feb. - Menteri Pertahanan, Datuk Seri Dr. Ahmad Zahid Hamidi hari ini mendedahkan, terdapat kedutaan asing di negara ini menggunakan Atase Pertahanan mereka bagi tujuan mengintip maklumat sulit negara terutamanya yang berhubung dengan soal ketenteraan.


Ahmad Zahid ketika mengesahkan perkara itu berkata, perbuatan tidak bertanggungjawab tersebut turut dibantu oleh ‘orang dalam’ Kementerian Pertahanan (Kementah) dan para pegawai Angkatan Tentera Malaysia (ATM).


''Kita mempunyai maklumat bahawa kedutaan asing menggunakan Atase Pertahanan mereka dengan dibantu oleh orang dalam untuk mendapatkan maklumat sulit negara. Orang dalam ini mungkin dibayar dan pihak kami telah kenal pasti pihak yang bertanggungjawab.


''Perkara ini saya akan bawa dan jelaskan kepada Perdana Menteri, Datuk Seri Najib Tun Razak sebelum tindakan susulan (ke atas kedutaan asing) diambil dan maklumat terperinci mengenainya didedahkan,'' katanya kepada pemberita selepas merasmikan perhimpunan bulanan kementerian itu di sini hari ini. - Utusan

KUALA LUMPUR : Kondominium Desa Damansara, Jalan Setiakasih, Bukit Damansara di ibu negara hari ini menjadi tumpuan perbicaraan kes liwat, Ketua Penasihat PKR, Datuk Seri Anwar Ibrahim. Lokasi tersebut didakwa menjadi tempat Anwar dituduh melakukan kesalahan tersebut.
Hakim Mahkamah Tinggi Kuala Lumpur, Datuk Mohamad Zabidin Mohd Diah dilaporkan bersama dengan pihak pendakwa raya serta peguam bela sedang menuju ke lokasi berkenaan ketika ini.
Perbicaraan ketika ini diadakan secara tertutup dan pihak media juga tidak dibenarkan mengikuti perbicaraan ketika ini.
Beliau yang juga penasihat Parti Keadilan Rakyat (PKR) dan Anggota Parlimen Permatang Pauh, dituduh meliwat Mohd Saiful di Unit 11-5-1 Kondominium Desa Damansara, Jalan Setiakasih, Bukit Damansara, antara 3.01 petang dan 4.30 petang pada 26 Jun 2008.
Dia dituduh mengikut Seksyen 377B Kanun Keseksaan dan boleh dihukum penjara sehingga 20 tahun dan disebat jika disabit kesalahan.

KUALA LUMPUR : Kira-kira jam 3 petang tadi Peguam Karpal Singh berhujah dalam perbicaraan dan menunjukkan tulisan akhbar Utusan Malaysia dengan tajuk 'Tak rela diliwat lagi' di halaman satu dan 'Berhenti kerana tidak mahu diliwat lagi' yang didakwa beliau menyeleweng.
Beliau juga menyatakan akhbar itu perlu dikenakan tidakan kerana menghina mahkamah.
Pada jam 3.10 petang pula, Pendakwa Yusuf Zainal Abiden pula menyatakan tidak adil untuk mengaitkan laporan Utusan dengan Perdana Menteri (PM) kerana beliau ialah Presiden umno.
Mahkamah pada jam 3.15 petang kemudiannya berhenti selama 5 minit untuk membuat keputusan di atas permohonan Karpal untuk mengenakan tindakan ke atas akhbar Utusan kerana menghina mahkamah.

SIAPA DIA SEBENARNYA

KUALA LUMPUR, Feb 4 — Nama Mohd Saiful Bukhari Azlan tiba-tiba menggegar negara apabila bekas pembantu peribadi kepada Datuk Seri Anwar Ibrahim itu membuat laporan polis dengan mendakwa bahawa dirinya diliwat oleh ketua pembangkang tersebut.

Saiful, 24, mula memberi keterangan sebagai saksi pertama dalam perbicaraan kes pendakwaan terhadap Anwar di Mahkamah Tinggi di sini yang bermula semalam.

Bekas pembantu peribadi Anwar itu memfailkan laporan polis di Pondok Polis Hospital Kuala Lumpur (HKL) pada 28 Jun 2008 lalu dengan menyatakan dirinya telah beberapa kali diliwat penasihat Parti Keadilan Rakyat (PKR) itu secara paksa dan menurutnya kejadian terakhir berlaku pada 26 Jun 2008 di Unit 1151, Kondominium Desa Damansara, Jalan Setia Kasih, Kuala Lumpur.

Saiful (gambar) yang dilahirkan pada 6 Julai 1985 merupakan anak kelahiran Johor Bahru, Johor yang dibesarkan dan bersekolah di Damansara di sini.

Beliau merupakan bekas penuntut jurusan kejuruteraan elektrik Universiti Tenaga Nasional (Uniten) di Bangi, Selangor tetapi gagal menamatkan pengajian.

Semasa di Uniten, beliau telah terpilih sebagai Timbalan Presiden Majlis Perwakilan Pelajar bagi sesi 2006/2007 selain dipilih sebagai Ketua Pengarah Program Bakti Siswa Kemerdekaan 2006.

Setelah berhenti belajar di Uniten tanpa segulung ijazah kejuruteraan, Saiful menjadi sukarelawan di pejabat PKR di Petaling Jaya sebagai pembantu khas Anwar selain membantu ketua staff, Ibrahim Yaacob untuk menguruskan jadual Anggota Parlimen Permatang Pauh itu.

Menurut Saiful dalam blognya, antara tugasnya ialah mengatur pertemuan sulit dengan anggota parlimen yang ingin melompat parti di mana pertemuan itu diadakan di Kondominium Desa Damansara tersebut yang dakwanya milik teman rapat Anwar.

Sepanjang bertugas bersama Anwar, beliau pernah mengikut majikannya itu ke luar negara termasuk ke Hong Kong (awal Mei 2008), Bangkok (akhir Mei 2008) dan Singapura (16 dan 18 Jun 2008).

Pada 15 Ogos lalu, Saiful telah melakukan sumpah laknat atau mubahalah di Masjid Wilayah Persekutuan dengan mengatakan bahawa dirinya telah diliwat secara paksa oleh Anwar pada 26 Jun lalu.

Kemudian, dalam satu sidang akhbar di sebuah hotel, yang merupakan pertama kali beliau muncul sejak membuat laporan polis itu, Saiful menafikan tindakannya itu bermotifkan politik.

Pada 3 Mac tahun lepas, beliau membuat laporan polis terhadap sebuah blog yang mendakwa beliau kini tenat akibat sumpah laknat yang dibuatnya dengan memfitnahnya bahawa beliau terpaksa menggunakan tiub bagi membolehkannya membuang air besar serta alat sulitnya bernanah.

Dalam pada itu perkara yang agak menghairankan banyak pihak ialah kemampuan Saiful menyewa Unit 1151, Kondominium Desa Damansara tersebut yang sewa bulanannya adalah antara RM7,500 dan RM15,000 memandangkan beliau tercicir dalam pelajaran dan jenis pekerjaannya.

Beliau turut mewujudkan blog mohdsaifulbukhari.blogspot.com pada Jun 2008 dan penulisan pertamanya pada 7 Julai bertajuk “Buat Rakyat Malaysia” telah mencabar Anwar untuk bermubahalah di hadapan ulamak manakala penulisan kedua bertarikh 20 Julai telah menyentuh tentang fitnah berkaitan dengan tunangnya.

Saiful telah bertunang dengan penyampai berita sambilan di sebuah stesen televisyen swasta, Janna Syariza Mohd Zaki, yang juga mempunyai blog “A Step In My Pink Mary Janes” yang menyatakan memberi sokongan penuh kepada tunangnya itu. — Bernama

KUALA LUMPUR : Fitnah kali ke 2 yang melanda Ketua Pembangkang, Datuk Seri Anwar Ibrahim jelas menunjukkan sistem politik Malaysia yang runtuh.
"Kes Anwar bukan kes individu dan ia berkait rapat dengan Pakatan Rakyat (PR). Sekali lagi jentera kerajaan digunakan golongan elit untuk mengalih perhatian rakyat mengenai isu-isu besar negara seperti kehilangan enjin jet, rasuah, penyelewengan dan sebagainya," tegas Ahli Parlimen Batu, Tian Chua dalam sidang media di pejabat utama PKR.
Menurut Tian, PR akan mengadakan kempen 'Selamatkan Malaysia' supaya dapat menyalurkan maklumat kepada rakyat dan secara langsung dapat memberikan rakyat peluang untuk membuat keputusan.
"Sesi ceramah 'Selamatkan Malaysia' akan diadakan di seluruh negara dengan tujuan menyeru kepada rakyat supaya bangkit dan menyelamatkan Malaysia dari sebarang penindasan dan penyelewengan dari segi moral, ekonomi dan politik.
"Kita juga akan membawa kempen ini ke pentas yang lebih besar lagi," jelas Tian Chua.
Beliau berkata dalam sidang media yang diadakan di Pejabat Pusat PKR bagi menerangkan isu Anwar kepada rakyat. Sidang Media ini akan berlangsung setiap malam bermula malam tadi sejurus selepas perbicaraan Anwar di Mahkamah.

MUNGKIN TAK MAKAN MELEPAS DAN LAIN-LAIN GAMAKNYA

Laporan Perubatan yang dikeluarkan oleh Hospital Kuala Lumpur sebelum ini mengesahkan bahawa tidak ada sebarang tanda yang menunjukkan bahawa Saiful diliwat! Laporan ini ditanda tangani oleh tiga pakar perubatan daripada hospital berkenaan. Laporan dari HKL ini sekaligus mengesahkan laporan pertama dari Pusat Rawatan Islam (PUSRAWI) yang turut mengesahkan bahawa tidak ada sebarang tanda-tanda saiful diliwat.



Tetapi anehnya, semalam pihak pendakwaan menyatakan mereka akan mengemukakan keterangan bahawa kesan air mani daripada spesimen yang diambil dari dubur Mohd Saiful Bukhari Azlan yang telah disahkan oleh Jabatan Kimia, milik Datuk Seri Anwar Ibrahim bagi membuktikan kesalahannya meliwat Mohd Saiful. Peguam pembela sepatutnya boleh mempersoalkan mengenai kewujudan spesimen berkenaan di dubur Saiful sedangkan laporan hospital mengesahkan tidak diliwat. Apakah tidak mungkin spesimen itu boleh saja dimasukkan selepas Saiful menjalani pemeriksaan doktor?.

PERBICARAAN DI LAKUKAN SECARA TERTUTUP

KUALA LUMPUR, Feb 4 — Perbicaraan kes liwat kedua Datuk Seri Anwar Ibrahim disambung pagi ini secara tertutup.

Bekas pembantu peribadi Anwar, Mohd Saiful Bukhari Azlan yang merupakan saksi pertama menyambung keterangannya pagi ini.

Sebahagian sesi perbicaraan petang semalam juga diadakan secara tertutup atas permintaan peguam Anwar.

Semalam Mahkamah Tinggi yang memulakan perbicaraan kes liwat Anwar, digemparkan dengan dakwaan mangsa Saiful bahawa beliau diajak oleh ketua pembangkang itu untuk mengadakan hubungan seks di luar tabii.

Saiful, 24 yang merupakan saksi pertama pendakwaan berkata perkara itu berlaku pada 26 Jun 2008 selepas beliau dan Anwar selesai berbincang mengenai jadual kerja di sebuah unit kondominium Desa Damansara di sini.

Ketika pemeriksaan utama oleh Peguam Cara Negara II Datuk Mohd Yusof Zainal Abidin, Saiful berkata pelawaan Anwar itu dibuat selepas beliau menyerahkan dokumen yang dibawanya dari pejabat kepada Anwar.

PULAU PINANG, 4 Feb: PAS Pulau Pinang melarang semua pemimpin, ahli dan penyokong terlibat dalam mana-mana demonstrasi yang menimbulkan isu perkauman serta menjejaskan keharmonian rakyat dan kerajaan negeri.

Pesuruhjaya PAS negeri, Ustaz Salleh Man berkata, agenda tersebut mempunyai maksud yang tersirat dan berkepentingan politik.

Ini berikutan pihak tertentu merancang mengadakan demonstrasi esok (Jumaat) di beberapa buah masjid ekoran perasaan tidak puas hati terhadap perobohan gerai oleh pihak berkuasa tempatan (PBT).

Dalam kenyataan kepada Harakahdaily, beliau berkata, kerajaan negeri mempunyai saluran yang boleh diketengahkan dan bukan dengan cara berdemonstrasi.

Katanya, demonstrasi itu akan memberi lampu hijau kepada pihak musuh yang senantiasa mencari punca untuk menghentam Kerajaan Pakatan Rakyat.

"Semua organisasi PAS di negeri ini disaran menjadi pemantau serta menasihati para ahli dan penyokong agar jangan terlibat dengan demonstrasi yang didalangi Umno dan Barisan Nasional," ujarnya.

Beliau yang juga Ahli Dewan Undangan Negeri (Adun) Permatang Pasir menambah, tindakan mengadakan demonstrasi tidak akan menyelesaikan masalah bahkan menjadi bertambah kusut.

“Jadi untuk mengatasinya, semua parti dalam gabungan Pakatan Rakyat tidak duduk diam bagi merangka berbagai pelan bersama," jelasnya.

Menurutnya, memang tidak dinafikan ada perasaan tidak puas hati di kalangan rakyat terutamanya mangsa, namun mereka diharap bersabar apabila kerajaan negeri menyediakan kawasan baru sebagai jalan penyelesaian.

ImageTrial gets underway in a case designed to sideline the opposition leader permanently

Malaysian opposition leader Anwar Ibrahim went to court today in Kuala Lumpur on charges of sodomizing a former aide in a trial that to everybody but the government itself appears to be built on dubious allegations that were laid to derail the first realistic challenge to the ruling national coalition since the country was formed.

The trial takes place in an increasingly shaky country, with a sclerotic government faced with a challenge not only from the formal opposition but from a fast-growing Malay nationalist movement, an NGO called Perkasa, which looks as if it is seeking to tow the United Malays National Organisation, the leading ethnic political party, into a violent confrontation with the Chinese community over so-called Ketuanan Melayu, or ethnic Malays-first rights. Police warned against illegal gatherings in connection with the trial.

Anwar, most impartial observers feel, is virtually certain of being railroaded into jail on the current charges unless the judiciary shows some uncharacteristic backbone. If he is jailed, even a short sentence is likely to end his political career. The appeals process could take as long as two years, court observers say. Where that leaves the country is open to question. If he remains free on appeal, Anwar, who has led rallies all over the country in recent weeks to large crowds, could well return to his previous status as a political martyr, which he was during his previous jailing on similar charges in 1998.

At this point, there is no real viable opposition political successor to Anwar waiting in the wings. Attempts to groom them have fallen apart on political infighting. The opposition coalition has been reeling from a series of defections, missteps and intense pressure from the Barisan Nasional, the national ethnic ruling coalition, which has used its political power in a variety of ways.

The case against Anwar was briefly adjourned while his lawyers sought to review an earlier decision denying him access to prosecution evidence. A chaotic scrum of reporters, photographers and supporters greeted the 63-year-old head of Parti Keadilan Rakyat, or the People's Justice Party as he and his lawyers entered the court.

At best, the charges appear to be a selective prosecution in a country in which a long string of top politicians have been complicit in a long string of crimes, not just of murder or assault but massive corruption. Najib Tun Razak, the current prime minister as defence minister engineered the purchase or lease of three French submarines that netted his best friend €117 million in commissions. That was just one of a variety of questionable defense purchases during his reign.

The aide, Mohd Saiful Bukhari Azlan, is acknowledged to have been photographed with and met with Najib after the supposed sodomy took place and before he filed the charges against Anwar. Dr Mohamed Osman, who examined the then 23-year old Saiful at Hospital Pusrawi Sdn Bhd on Jalan Tun Razak in Kuala Lumpur on June 28, 2008, filed a medical report that found no evidence of tearing or scarring that would indicate the youth had been sodomized. When Saiful went to another government hospital to obtain a diagnosis, doctors at that hospital refused to confirm that he had been sodomized as well. Nonetheless, Saiful filed the assault report four hours later at a nearby police kiosk.

Police later picked up the doctor and held him for three days, according to the website Malaysia Today, following his filing of the report that no assault had taken place. The doctor later went into hiding with his family. In an abbreviated interview with Asia Sentinel at the time, Deputy Inspector General of Police Ismail Omar confirmed that Dr Mohamad had been questioned, but said he had not been detained.

The charges against Anwar echo those that took place in 1998, when he was leading the charge against the government led by the United Malays National Organisation and the then-prime minister, Mahathir Mohamad, who had fired him as finance minister and deputy prime minister. The charges have been widely reported as spurious. The supposed victims of Anwar's sodomy later recanted all of the charges and said they had been tortured and beaten into making them.

Munawar Anees, an internationally respected biologist, was one of four men accused of having sex with Anwar. The others were Anwar's adoptive brother, his wife's driver and a fashion designer. Anees wrote extensively in a statutory declaration of the five days of torture, brutality and deprivation he had suffered prior to being forced into making the charge. The prosecution, faced with contradictions in testimony, repeatedly changed the dates and times the alleged sodomy had taken place. Nonetheless, Anwar was convicted on charges of abuse of power and sodomy and served six years in jail before Mahathir left office and his successor, Abdullah Ahman Badawi, came to power. The sodomy ruling was overturned by the courts in 2004.

Anwar was suspended from running for political office until 2008 because of the abuse of power charge. He almost immediately became a major force in Malaysian politics, cobbling together a disparate coalition of the Democratic Action Party, a largely Chinese left-of-center party, Parti Islam se-Malaysia, a fundamentalist Islamic party, and his own moderate, urban, largely Malay Parti Keadilan, and for the first time broke the national ruling coalition's 50-year two-thirds hold on parliamentary power.

The opposition leader was arrested a day after a nationally televised debate that most observers thought made his opponent look incompetent and out of touch. When Anwar refused to give a DNA sample, charging previous samples had been used in the spurious 1998 case against him, the Barisan pushed a bill through the Dewan Rakyat to allow police to collect samples in criminal cases without the consent of the suspect. Since that time, the charges against Anwar have been modified from forcible sodomy to consensual sex. Saiful, however, has never been charged although presumably he had consented to homosexual sex, a violation of Malaysian law. He has remained sequestered by law enforcement and unavailable to the press.
