SIAPA PERJUANGKAN KEMATIAN DALAM TAHANAN POLIS??

P. Uthayakumar, P. Waytha Moorthy and HRP has been portrayed by UMNO as racist and who would refuse to champion a Malay victim Anuar bin Sarip who tragically died in police custody at his prime at 31 years of age.

P. Uthayakumar kept the battle for justice going since 1999, some eleven years ago, irrespective of the ethnicity of the victim. In fact this is the very first of the series of death in police custody cases filed by P. Uthayakumar (and not an Indian victim).

Besides Anuar bin Sarip, even way back in 1994, P. Uthayakumar had defended police abuse and malicious prosecution case involving one Abdul Wahab bin Lakmit Hamzah bin Adam (himself an ex policeman) whose son died as a result of police over zealous enforcement.

Needless to mention at the height of the Reformasi movement P. Uthayakumar had defended hundreds of Reformasi protesters so much so that Harakah carried a feature article of “P. Uthayakumar Peguam Reformasi” (written by Zunar and Mr. Koya).

The very first (High Court) case involving an application for a Post Mortem Report was for Ho Kwai See (28) a coconut trader who also died in police custody. (Again a non Indian victim). All the above cases were undertaken by P. Uthayakumar on a pro bono basis.

But UMNO, Bernama and Berita Harian yesterday and today’s news blacked out and intentionally refused to acknowledge P. Uthayakumar ‘s role in the unprecedented RM 1.4 million civil suit case precedent that Anwar bin Sarip’s widow had won at the Kuala Lumpur High Court.

To us this is part and parcel of UMNO and the Malaysian police special branch’s political agenda in maintaining and sustaining the perception that Hindraf is racist and is not capable of defending a Malay victim. Also UMNO does not wish Hindraf and HRP to make inroads with the Malay community. It does not want to acknowledge that Hindraf is also a champion of the oppressed Malays. Imagine the irony, none of the Malay lawyers, NGOs, PAS, PKR or Umno stood up for oppressed Malays like Anuar Sarip. None! It took an Indian to stand up for the Malay when he had nowhere else to go.

Be that as it may the fact remains that an estimated 95% of the police shot dead by the police victims are Indians, 90% of the death in police custody victims are Indians and the most marginalized poor powerless and politically voiceless community in Malaysia are the Indians as they do not even have the social safety net of the traditional villages and ancestral land that the poor Malays, orang asli, Kadazan and Iban have that thye could fall back on. Even the Chinese poor have hundreds of their Chinese New Villages where they could find some daily casual work, temporary accommodation or simply a sanctuary when times are bad.

We have recent reported cases of Indian children eating sand and pebbles because of hunger and poverty. 90% of Indian children in Tamil schools did not attend kindergartens because of poverty. An Indian lady giving birth next to the drain in Brickfields because of the poverty. The single parent rate is 500% higher than in the Chinese community because of poverty. And the suicide rate is 600% higher than in the Malay community also because of poverty.

All this does not mean anything to the Malay or Chinese communities although it is they and their political parties who are responsible for discriminating and marginalising the Indians. Their attitude is to care a damn and simply grab everything for their own ethnic groups. and when Hindraf/HRP champions these issues, they are immediately shut out and branded as racists and ultras. This is their perverted way to avoid dealing with their own racist and chauvinistic follies.

And Hindraf and HRP will continue focusing on these pressing and critical Indian problems but with the least attention from BN, PR, NGOs, civil society, Indian elites and the print and electronic media, bloggers and the alternative media generally who go for championing and reporting on majoritarian issues (read Malay and Chinese issues) and to the gallery as opposed to the gravity and severity merits, and needs and problems which are most suffered by the most oppressed Malaysian Indian community .

If and only if the One Malaysian and the multi-racial Malaysian community media and NGOs do not sideline Indian problems just because they are poor, powerless and do not have an political effective voice, Hindraf and HRP would naturally have less focus on the Indian poor and would be seen to be more multi-racial.

But that is not seen to be coming. It is the omission and failure of the existing parties on both sides plus the NGOs that brought about the need for Hindraf.

Bagaimanapun, dalam jawapan yang dihantar menerusi peguamnya Americk Sidhu beliau berkata, sumber kewangannya bukan daripada orang lain tetapi “dana” diterima ahli perniagaan.

“Saya merujuk kepada kenyataan Ahli Parlimen Bebas Datuk Zahrain Hashim (semalam).

“Saya diarahkan oleh pelanggan saya untuk mengatakan bahawa dia menyokong penuh cadangan dibuat Datuk Zahrain atas alasan mudah yang mana wang yang digunakan untuk membayar perjalanan ke London dan penginapan adalah diperoleh daripada dana diterima daripada Deepak Jaikishan,” katanya.

Selepas portal-portal tempatan menyiarkan temu bual terbaru Balasubramaniam (gambar) akhir tahun lalu beberapa pemimpin atasan Pemuda Pakatan Rakyat menyerahkan laporan kepada SPRM dengan menamakan Datuk Mohamed Nazim Razak dan Deepak sebagai dua individu utama yang perlu disiasat.

Laporan media sebelum ini menyebut Deepak juga didakwa kenalan rapat Datin Seri Rosmah Mansor, isteri perdana menteri.

Di bangunan Parlimen semalam, Zahrain mendesak SPRM menyiasat individu yang terbabit menaja Balasubramaniam di London.

Beliau yakin ada individu yang menaja kehidupan Balasubramaniam di negara itu kerana mengetahui penyiasat berkenaan tidak mampu menetap di sana tanpa bantuan kewangan.

“Saya mendesak melalui menteri minta SPRM siasat siapa sponsor. Lagipun, saya tahu tidak mungkin Bala mampu duduk di London berbulan-bulan tanpa ditaja,” katanya.

Balasubramaniam mengundang kontroversi apabila pada 3 Julai 2008 muncul dan mengumumkan akuan bersumpahnya berkaitan pembunuhan wanita Mongolia, Altantuya Shaariibuu.

Bagaiamanapun keesokannya, beliau menarik balik kenyataan akuan sumpah awalnya itu melalui akuan sumpah kedua dalam satu sidang media sebelum bertindak menghilangkan diri dipercayai ke luar negara bersama keluarganya.

Zahrain berkata episod kehidupan Balasubramaniam seakan menyerupai episod kehidupan pengendali portal berita Malaysia Today Raja Petra Kamarudin dan yakin pihak yang sama menaja kedua-dua individu terbabit.

Katanya berdasarkan pada bukti-bukti yang beliau peroleh, mendapati kedua-dua individu terbabit mendapat tajaan daripada parti pembangkang.

Beliau berkata dakwaan Parti Keadilan Rakyat (PKR) bahawa parti itu tidak mempunyai hubungan dengan Raja Petra adalah tidak benar.

IT USED to be that whenever it came to election time in Malaysia, the country's ruling party Umno would gets its community development workers to fan out to all the hamlets on bicycles and on foot to take the political temperature and assure villagers that Umno was the best doctor for them, taking care of their births, deaths and everything in between. But then village youth began migrating en masse to towns from the 1980s and Umno lost these rural forts.

Malaysian sociologist Maznah Mohamad recalls Umno's women telling her how urban folk would shoo them away and even hurl insults at them if they tried to woo them. Dr Maznah, 54, notes wryly: 'You can't go knocking on doors in, say, Subang Jaya. People will just chase you away. There's no community spirit in such neighbourhoods. Anyway, they're urbanised, so why would they need you to help them?'

An alumna of Macalester College, Stanford University and the University of Malaya, Dr Maznah knows a lot about such matters, having studied Malays in general, and Umno in particular, in her 27 years as a don in Penang's Universiti Sains Malaysia (USM).

She retired from USM in 2006, and has since been a visiting senior research fellow at the National University of Singapore's Asia Research Institute. Her husband, Dr Johan Savaranamuttu, is a visiting senior research fellow at the Institute of Southeast Asian Studies here. They have two children.

She spoke to The Straits Times recently about her country's New Economic Model (NEM) and where Umno stands today:

· Who is the average Malaysian Malay today?

He is male, Muslim and has an excess of rights and privileges without too much responsibility, for he benefits from what I call a vulgarised affirmative action policy formally known as the New Economic Policy (NEP).

· Why 'vulgarised'?

Simply because it has veered from its original aim and has metamorphosed into a scheme that equalises rewards rather than opportunities... After a while, even a conscious policy like that is not necessary because it assumes its own dynamics - like people from the same ethnic group drawing their own (into workplaces), so you don't even need racial quotas... But it is difficult to undo a policy that's so entrenched.

· So life is good for the average Malaysian Malay?

Besides NEP rights, Malaysia's Islamic laws today are biased towards male rights, such as polygamy and the unilateral right to divorce. Even Jakim, the Department of Islamic Development, has had to set up a RM15 million (S$6.4 million) fund to assist single mothers who have not received maintenance from their children's fathers. This is not good because the state picks up after these errant males... The average Malay male is treated with kid gloves.

· Why so?

Well, there's really a lot of disjuncture in the system. The (average Malay) has all these rights and privileges, but for a Muslim man who's poor, that's where the problem starts: Psychologically, he might think that he's powerful and head of the household but, realistically, he's not able to maintain it... That's why you find many among them just leaving the family. You also have Muslim wives who earn a lot more than their husbands, yet are forced to be obedient and subservient. There is this whole entrenchment of a kind of politics and culture that does not actually assess (Malays) realistically.

· So what is Umno's attraction to them these days?

The attraction in joining Umno today is still that it's a sure ticket to a plum appointment or business contract because there isn't anything idealistic in Umno today. Sixty years ago, it was about wanting to help the Malays but that is not so today because Malay rights and privileges are already guaranteed in the Constitution... If Umno pays you RM300 a month to deliver letters to its branches, that's enough to pay, say, the loan on your motorcycle. So Umno is more like a job than a party at the end of the day.

· Which begs the question: Who wouldn't want to join it?

Well, those who don't need to, don't have to, right? Also, those who join the opposition Parti Islam SeMalaysia (PAS) have an idealism that has trumped even material benefits.

· That puts Umno in quite a spot, surely?

Exactly. Umno's lifeblood has been helping the Malays get to a certain level. So if the Malays are backward and not able to catch up, Umno would then be forever relevant... But now, what other language can Umno use?

· So why are its leaders saying the NEM must replace the NEP?

In a way, it's the right moment to do so because, on the one hand, Prime Minister Najib Razak isn't exactly all that strong because he hasn't gone through the baptism of elections and was endorsed by Umno when it was at its weakest. On the other hand, you have a growing Malay middle class that is clamouring for reform. This convergence of the weak and the strong makes Malaysia ripe for the NEM.

Having said that, it's a misnomer to call the NEM a model. It's really just a government wish list. Nevertheless, it's going to provide a platform for some very important talking points.

· How fresh are these points?

There are three which have not been stated explicitly before: The first links corruption to the faltering economy; before, corruption was there but it wasn't considered a moral evil... But now the NEM has made that connection, albeit with the fancy-sounding term 'rent-seeking in economic practices'. The second is trying to get rid of affirmative action, using the code phrase 'affirmative action that is friendly to market policy' - which is an oxymoron, right? The third - and this is very important - is how they're going to stimulate the economy by bringing back 'talented Malaysians' which, again, is a code phrase for non-Malays... I don't know if that's possible under the present circumstances, but at least they've identified that as what they've to do. So let's give them the benefit of the doubt.

These three things are good because a good policy has something which people desire commonly. So the NEP was very successful because it was made out to be something that could prevent future ethnic conflicts and also eradicate poverty - and who could quarrel with that?

· But hasn't the NEP rendered Malaysians uncompetitive?

Yes, but it never hurt the economy - until now - and so Umno became complacent and mixed up short-term necessities with long-term realities.

· Can Umno change?

The only way it can change is if it loses... That's because nothing has changed in Umno, not even its rhetoric. Has money politics changed? No. Histrionics? No. Keris-waving? No.

· Is this Umno's darkest period yet?

There are two ways of looking at it. If you view it in terms of election performance, Umno did very badly in 2008. But if you're looking at Umno versus PAS, Umno is still ahead of PAS by a long shot. In Umno's worst years, 1969 and 2008, it won 35 per cent of the parliamentary seats. PAS' best year was 1999, when it won just 14 per cent of the parliamentary seats. See the gap?

· So who or what is Umno's biggest threat now?

Fence-sitters. The 2008 election was really about them; a lot of seats were won very narrowly and that was when the fence-sitters mattered.

Hal ini disuarakan oleh pensyarah undang-undang Universiti Islam Antarabangsa (UIA), Profesor Aziz Bari.

Beliau yang dipetik oleh TV Selangor berkata ketiga-tiga jawatan berkenaan adalah lantikan kerajaan persekutuan yang disyaki berperanan sebagai tali barut kerajaan pusat untuk mengkucar-kacirkan kestabilan di negeri yang ditadbir Pakatan Rakyat.

"Oleh kerana penasihat undang-undang, pegawai kewangan negeri dan setiausaha kerajaan negeri adalah anggota kabinet negeri, jadi mereka ini mungkin membocorkan rahsia negeri kepada pusat," katanya.

"Gaji dibayar oleh negeri tetapi kesetiaan dan kiblat mereka kepada kerajaan persekutuan kerana kita faham mereka ini dipilih oleh peguam negara untuk mengkucar-kacirkan. Ini yang berlaku," katanya lagi.

Mongolian government says it will fund a civil suit against Malaysia and Altantuya's onetime lover


The Mongolian government has agreed to put up RM60,000 (US$18,525) to fund a civil suit in Kuala Lumpur on behalf of the family of translator Altantuya Shaariibuu against the Malaysian government and the murdered woman's onetime lover, Abdul Razak Baginda, a former close friend of Prime Minister Najib Tun Razak. Two of Najib's former bodyguards were convicted of the gruesome 2006 murder.

Although details are sketchy, remittance order issues were submitted to the Mongolian Cabinet during June meetings, a source in Ulan Bataar told Asia Sentinel. Some of the remittance orders were classified as secret, the source said. The case has strained relations between Malaysia and Mongolia, with the Ministry of Foreign Affairs saying earlier that the government was carefully observing the trial of the two convicted murderers and had sent four letters through official channels asking that the case be prosecuted free of political influence.

Altantuya's death is at the center of a much larger scandal stemming from the billion-dollar purchase by the Malaysian government of two French submarines and the lease of a third in a deal engineered by Najib when he was defense minister. The purchase was routed through a company owned by Abdul Razak Baginda in a transaction that netted the company €114 million in “commission.”

French lawyers are investigating the case over allegations that large sums were kicked back to top French politicians. For two years, Parisian prosecutors have been investigating other allegations involving senior French political figures up to former French President Francois Mitterrand and the sales of submarines and other weaponry to governments all over the world. French news reports have said the prosecutors have backed away from some of the most serious charges out of concern for the political fallout.

As Asia Sentinel reported on April 16, the allegations relate to one of France's biggest defense conglomerates, the state-owned shipbuilder DCN, which merged with the French electronics company Thales in 2005 to become a dominant force in the European defense industry. DCN's subsidiary Armaris is the manufacturer of Scorpene-class diesel submarines sold to India, Pakistan and Malaysia among other countries. All of the contracts, according to lawyers acting for Suaram, a Malaysian human rights NGO, are said to be suspect. In April, Joseph Breham, one of the lawyers, flew to Kuala Lumpur to interview witnesses in the case. Altantuya told witnesses at her trial that she had been involved as a translator in the submarine matter and that she had been promised US$500,000 for her role.

After a marathon trial involving 75 witnesses, a court in the Malaysian suburb of Shah Alam exonerated Razak Baginda of involvement in her murder without his having to put on a defense. He almost immediately left the country for England. The two convicted bodyguards, Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar, were members of an elite Malaysian police unit that normally exists to protect diplomats. Although one of the two told investigators they had been offered RM100,000 to kill the woman, the court did not attempt to find out who had offered them the money. Najib has repeatedly denied knowing her although a complex web of circumstantial evidence ties the two together. He has threatened to sue anyone who attempts to link him or his wife, Rosmah Mansour, to the case.

P Balasubramaniam, a private investigator and retired policeman hired by Abdul Razak to keep the jilted Altantuya away from him, filed a statutory declaration in a Kuala Lumpur court in 2007 alleging that Najib not only knew the murdered woman but was formerly her lover and introduced her to Abdul Razak to get rid of her because it would be unseemly to have a mistress when, as expected, he took over as prime minister. Balasubramaniam was intimidated into recanting his statement and promptly disappeared. He resurfaced to reiterate the charges and is scheduled to give a press conference on July 7 at 11 am in the Holiday Villa in London to give further details. Altantuya's father, Setev Shaariibuu, a university professor, has made it a longtime crusade to attempt to find out what really happened to his daughter. At one point he attempted to meet Najib at Malaysia's parliament building but was rebuffed. He is seeking RM100 million from the Malaysian government and Razak Baginda in the civil suit. However, he later told reporters he didn't have the money for the security bond, saying his efforts to get help from the Mongolian government had failed.

Karpal Singh, a Democratic Action Party leader and lawyer representing the Shaariibuu family, told the news portal Malaysian Insider that the RM60,000 had been transferred to his firm's account on Monday and that it would be deposited with the Shah Alam High Court, where the trial of the two bodyguards had taken place, on June 30. He had earlier said he would help Shaariibuu get the money from the opposition Pakatan Rakyat coalition if necessary.

According to Malaysian Insider, the government and Abdul Razak said Shaariibuu should bear the cost of the civil suit. The court initially fixed the security bond at RM1.25 million, but lowered it to RM30,00 per party in March after Shaariibuu protested. Shaariibuu, the story said, is also required to pay Abdul Razak and the federal government a further sum of RM5,000 each for the cost of the court application.

Nakhaie: Ulama muda sertai Umno terap ‘ideologi’ Asri

KUALA LUMPUR, 1 Julai — Bekas Yang Dipertua Yayasan Dakwah Islamiah Malaysia (Yadim), Datuk Nakhaie Ahmad mendakwa kumpulan 40 ulama yang menyertai Umno Jumaat lalu adalah pengikut bekas mufti Perlis Dr Mohd Asri Zainul Abidin dan mempunyai agenda tersendiri apabila menyertai parti itu.

Beliau berkata Asri menghantar pengikutnya supaya aliran pemikiran dan idealoginya dapat disalurkan ke dalam kepimpinan Umno.

“Ulama yang menyertai Umno baru-baru ini adalah pengikut Asri yang dihantar untuk menyampaikan aliran pemikiran beliau ke dalam Umno.

“Asri menghantar ulama ini dengan harapan mendapat kedudukan yang penting dalam Umno ataupun kerajaan.

“Jadi apabila sudah ada kedudukan yang baik mudah untuk mereka terapkan idealogi Asri,” katanya ketika dihubungi The Malaysian Insider hari ini.

Dari awal Nakhaie, yang merupakan bekas naib presiden PAS tetapi sertai Umno, tidak mempunyai hubungan “baik” dengan Asri.

Akhir Februari lalu Nakhaie memfailkan saman fitnah RM1.5 juta terhadap Asri dan tujuh yang lain termasuk editor dan wartawan akhbar Sinar Harian.

Dalam pernyataan tuntutan itu, Nakhaie, yang kini berkhidmat sebagai Pengerusi Pertubuhan Kebajikan Islam Malaysia (Perkim), mendakwa Asri telah mengeluarkan tiga kenyataan fitnah terhadapnya dalam satu persidangan media pada 1 November tahun lepas dan dua artikel yang diterbitkan oleh Sinar Harian pada 2 dan 5 Nov tahun yang sama.

Katanya, kenyataan fitnah itu telah memberi gambaran buruk bahawa beliau adalah pihak yang menjadi dalang dalam isu memorandum menentang pelantikan Asri daripada menjadi Yang Dipertua (YDP) Yadim, dan ada penyelewengan berlaku di institusi tersebut.

Nakhaie juga mendakwa akibat daripada tindakan fitnah daripada defendan pertama yang dikeluarkan akhbar terbabit, kewibawaan dan reputasinya kian merosot.

Beliau berkata Umno perlu sentiasa berhati-hati dengan kehadiran kumpulan ulama tersebut kerana dikhuatiri akan memberikan kesan kepada kepimpinan parti itu dan juga pentadbiran kerajaan.

“Apabila seseorang menyertai Umno sudah pasti mereka mempunyai agenda tertentu termasuk kumpulan ulama itu kerana kita tidak tahu apa tujuan utama mereka menyertai Umno.

“Jika apa yang ingin disampaikan itu adalah idea politik ia tidak mempunyai masalah tapi kalau berkaitan dengan agama bimbang ia akan bercanggah dengan institusi agama seperti Majlis Agama Islam, Jabatan Agama Islam dan Jabatan Mufti.

“Ini kerana bukan semua idea berkaitan agama kita boleh terima bulat-bulat, sama seperti fahaman yang dibawa Asri ada yang kita setuju ada yang tidak. Jadi kepimpinan Umno perlu peka akan perkara ini,” katanya.

Beliau berkata demikian ketika diminta mengulas tindakan sekumpulan 40 ulama yang berusia antara 20-an dan 40-an menyertai Umno pada minggu lepas.

ZIARAH PEJUANG-OLEH AHMAD NIZAM HAMID


Kawan Tahir atau lebih dikenali oleh kawan-kawan Rejimen Ke-10 sebagai Penghulu adalah seorang kader veteran yang amat dihormati oleh para perajurit. Beliau pulang ke kampung halamannya selepas Rejimen Ke-10 memberhentikan perjuangan bersenjata selaras dengan perjanjian perdamaian 3 pihak antara Kerajaan Malaysia, Kerajaan Diraja Thailand dan Pari Komunis Malaya yang ditandatangani di Hadyai pada 2 Disember 1989. Saya sering menyebut malah menulis juga bahawa bangsa kita kelihatannya terlalu miskin jiwa untuk memberikan penghargaan kepada mereka-individu mahupun kumpulan-yang menyumbang kepada perjuangan.Penghargaan malah catatan sejarah hanya di juruskan kepada UMNO (dan pemimpinnya) seolah-olah hanya UMNO-Perikatan-Barisan Nasional sahaja yang menyumbang kepada kemerdekaan tanahaiar.



Hari ini,bersama Sdr.Syed Hamid Ali,Bung Hassan Karim,Pak Sanusi Abas dan Bung Tajudin Ramli sempat mengziarahi seorang pejuang yang sedang terlantar keuzuran di Kg.Bangau Tanjung Temerloh.Pejuang tersebut merupakan salah seorang anggota Rejimen Ke-10 Tentera Pembebasan Malaya,PKM yang memilih untuk kembali ke tanahair berikutan Perjanjian Damai Tahun 1989 dahulu.




Pak Abdullah Ibrahim yang juga dikenali dengan nama Tahir dan Penghulu sekarang ini sedang keuzuran terlantar di teratak usang milik keluarga isteri beliau.Anak Semantan yang berjiwa kental ini lahir di Kg.Tualang Temerloh memilih menyertai perjuangan bersenjata Rejimen Ke-10 didalam usia 18 tahun.




Semangat untuk merdeka dan menghalau penjajah British serta kesedaran politik yang mendalam mendorong beliau memilih perjuangan bersenjata.Kebenciannya yang membuak akan penjajahan membuatkan beliau tanpa tangguh mempertaruhkan nyawanya bergerila di hutan belantara.


Beliau menyertai long march Rejimen Ke-10 ke sempadan Thailand bersama denganAbdullah CD dan sahabat-sahabatnya yang lain;atas nama perjuangan beliau memilih berkelana ke negeri orang lain dari memilih berputih mata tunduk kepada penjajah.


Tahir telah menyumbang seluruh usia mudanya kepada perjuangan yang beliau yakini;lebih 40 tahun-sebahagian besar dari usianya-untuk perjuangan membebaskan bangsa dan tanahairnya dari cengkaman British.


Dan lelaki ini tidak pernah menyesali pilihan yang diambilnya.Dalam keuzuran dengan suara yang perlahan tapi tegas,beliau menyebut bahawa beliau tidak pernah kesal dengan perjuangannya.Saya mengesani kekukuhan semangat dan kekentalan hatinya yang saya kira kukuh-kejap bersemangat untuk berjuang.



Pak Abdullah Ibrahim atau Penghulu hari ini hanya mampu terbaring di rumah sahaja dengan di temani seekor kucing comel yang setia berbaring sepanjang waktu di sisinya.Beliau mengidap sakit pasang atau mempasang,ulu ari-arinya bengkak.Tubuhnya kini kurus jangkung tanpa daging namun matanya tetap bercahaya dan tajam.


Pejuang ini hidup didalam kedaifan tetapi masih bersemangat kental.
