Setelah saya mendedahkan klip video Lingam kepada orang ramai kira-kira tiga bulan yang lalu, kerajaan kini telah mengumumkan keanggotaan dan terma rujukan Suruhanjaya DiRaja untuk menyiasat rasuah kehakiman.

Pada mulanya, kerajaan tidak mengendahkan isu ini tetapi kemudiannya hanya bersetuju membentuk panel tanpa bidang kuasa jelas. Justeru itu, keputusan menubuhkan Suruhanjaya Di-Raja kami anggap sebagai langkah positif untuk mengembalikan integriti kehakiman Negara. Kami mengucapkan tahniah kepada ribuan rakyat Malaysia yang telah menuntut reformasi kehakiman.

Malangnya, terma rujukan Suruhanjaya DiRaja ini tidak memenuhi bidangkuasa yang sewajarnya untuk memulakan siasatan menyeluruh terhadap krisis yang dihadapi institusi kehakiman, sebagaimana yang dituntut Majlis Peguam, badan-badan bukan kerajaan dan lain-lain pertubuhan masyarakat. Kewujudan video ini merupakan bukti bahawa krisis ini cukup mendalam dan telah melibatkan peringkat tertinggi institusi kehakiman. Kami kesal bahawa Suruhanjaya ini tidak diberikan bidangkuasa yang secukupnya untuk menyelesaikan masalah yang telah ditimbulkan oleh video ini.

Penglibatan Tan Sri Haidar dan Tan Sri Steve Shim sebagai pesuruhjaya juga menimbulkan beberapa persoalan. Suruhanjaya DiRaja telah dipertanggungjawabkan untuk menyiasat semua perkara berkaitan dengan nama-nama yang disebut di dalam video ini, termasuk saya, yang dirujuk sebagai "Kes Anwar" di dalam video tersebut. Walaubagaimanapun, saya perlu menarik perhatian disini bahawa Tan Sri Haidar dan Tan Sri Steve Shim adalah antara hakim yang mendengar kes saya di Mahkamah Persekutuan. Di dalam perkara ini, kami berharap mereka bertindak waras bagi mengenepikan sebarang tanggapan negatif yang mungkin bersangkit di dalam penyiasatan Suruhanjaya DiRaja.

Namun demikian, kami masih komited untuk memberikan kerjasama penuh dengan Suruhanjaya DiRaja dengan harapan bahawa anggotanya mempunyai keberanian melaksanakan amanah mereka dengan jujur dan ikhlas. Rasuah, muslihat perlantikan hakim dan ketidakadilan yang dilaksanakan di dalam penghakiman adalah masalah serius yang perlu ditangani.

Untuk memenuhi janji saya sebelum ini, saya dengan ini memberikan klip penuh video tersebut selama 14 minit dan akan memberikan kerjasama penuh kepada Suruhanjaya DiRaja. Video tersebut boleh ditonton di:

Anwar sangsi penglibatan Haidar dalam suruhanjaya siasat 'Pita Lingam'

KUALA LUMPUR, 14 Dis (Hrkh) - Penasihat Parti Keadilan Rakyat (KeADILan), Dato' Seri Anwar Ibrahim Anwar Ibrahim hari ini melahirkan kesangsian dengan penglibatan Tan Sri Haidar mohamed Nor dan Tan Sri Steve Shim dalam Suruhanjaya DiRaja siasatan 'Pita Lingam'.

Penglibatan Haidar dan Steve Shim sebagai anggota suruhanjaya juga menimbulkan beberapa persoalan, katanya.

Anwar berkata demikian semasa mengadakan sidang media dan pendedahan baki pita video yang menunjukkan perbualan seorang peguam yang didakwa sebagai VK Lingam dengan seorang bekas hakim yang didakwa sebagai Tun Ahmad Fairuz Sheikh Abdul Halim.

Antara yang hadir ialah, Timbalan Presiden KeADILan, Dr Syed Husin Ali; Peguam yang juga Bendahari KeADILan, William Leong dan Pegawai Khas Anwar, Din Marican.

Haidar terbabit dalam kes Anwar

"Suruhanjaya DiRaja telah dipertanggungjawabkan untuk menyiasat semua perkara berkaitan dengan nama-nama yang disebut di dalam video ini, termasuk saya, yang dirujuk sebagai 'Kes Anwar' di dalam video tersebut," kata Anwar.

Walaubagaimanapun, kata Anwar beliau perlu menarik perhatian di sini bahawa Haidar dan Steve Shim adalah antara hakim yang mendengar kes beliau di Mahkamah Persekutuan.

Dalam perkara ini, KeADILan berharap mereka bertindak waras bagi mengenepikan sebarang tanggapan negatif yang mungkin bersangkit di dalam penyiasatan Suruhanjaya DiRaja, kata Anwar.

Namun demikian, kami masih komited untuk memberikan kerjasama penuh dengan Suruhanjaya DiRaja dengan harapan bahawa anggotanya mempunyai keberanian melaksanakan amanah mereka dengan jujur dan ikhlas, katanya.

Siasat rasuah kehakiman

Dedah pita kedua

Kewujudan video ini merupakan bukti bahawa krisis ini cukup mendalam dan telah melibatkan peringkat tertinggi institusi kehakiman, kata Anwar.

KeADILan kesal bahawa suruhanjaya ini tidak diberikan bidang kuasa yang secukupnya untuk menyelesaikan masalah yang telah ditimbulkan oleh video ini, katanya.

"Rasuah, muslihat perlantikan hakim dan ketidakadilan yang dilaksanakan di dalam penghakiman adalah masalah serius yang perlu ditangani.

"Untuk memenuhi janji saya sebelum ini, saya dengan ini memberikan klip penuh video tersebut selama 14 minit dan akan memberikan kerjasama penuh kepada Suruhanjaya DiRaja," kata Anwar.

Anwar telah mendedahkan baki klip video tersebut yang menunjukkan babak perbualan antara VK Lingam dengan seorang yang dipercayai ahli perniagaan.

"Kita mempunyai bukti mengenai pelakuan keseluruhan mereka yang disebut dalam pita tersebut–peranan VK Lingam, Tan Sri Vincent Tan, Dato' Tengku Adnan, wang yang diberikan kepada bekas Peguam Negara, Tan Sri Mokhtar Abdullah dan bekas Ketua Hakim Negara, Tun Eusoff Chin," kata Anwar semasa menjawab soalan wartawan.

"Selain daripada apa yang dikatakan oleh adik Lingam (VK Thirunama Karasu), kita mempunyai bukti lain untuk menyokongnnya," katanya.

Perbualan tersebut boleh ditonton melalui laman web rasmi KeADILan, www.keadilanrakyat.org.

Anwar juga berkata bahawa pihak yang menyerahkan pita itu kepadanya akan turut tampil memberi kerjasama kepada suruhanjaya.

Begitupun Anwar enggan mendedahkan nama-nama individu yang menyerahkan pita video asal itu kepadanya dan hanya berkata akan tiba masanya 'whistleblower' itu mendedahkan identitinya apabila suruhanjaya memulakan siasatan.

Lingam: I put him up there. Don’t tell this, please. I cannot tell this to Manjit. And he is acting President Court of Appeals Number 2 post. He is next Chief Justice. He always says “I leave it to you.”

[Voice off-camera]: I thought you were very close to Tun Eusoff Chin, Datuk?

Lingam: He is Eusoff Chin’s man, Eusoff Chin retired. But Dzaiddin hates Eusoff Chin, you understand? Ah..

[Voice off-camera]: Because you know I…I…I..as far as I know you are very…

Lingam: Eusoff Chin and I are extremely close. Because you know…Yeah. Eusoff Chin in power, I can straight and get in Pom! Pom! Pom! Pom! But now Dzaiddin is there. So Dzaiddin is attacking our cases. That means what? James Kumar is aligned to Dzaiddin. But Dzaiddin is retiring in 15th of September. He is finished.

[Voice off-camera]: Next year?

Lingam: So Dzaiddin really wants to go…Don’t worry. Dzaiddin recommended Malik Ahmad to be Chief Judge of Malaya. But we went and “cut” “cut” cut” cut” I and Tengku Adnan and Vincent told PM. I stop him for now, because he is anti-PM. We put Fairuz in. And we put…I told you three months ago he became CJM [Chief Justice Malaya]. He said “Don’t believe.” Then he got it. He rang up to thank me. And all that. He now acting PCA because Wan Adnan is sick. Right? This. Apart from law knowledge you need kow tow. Please understand that. You need to know the emperor. Knowing the law doesn’t give you the winning formula, you must also kow tow to the emperor. Correct or not? So now I am working very hard. So he agreed to meet Vincent Tan and PM and…what you call Tengku Adnan.

[Voice off-camera]: Do you think Vincent has an interest over PM?

Lingam: You don’t know about the history. Businesswise may not be successful. Robert Kuok is very brilliant. Lim Goh Tong is very rich. Vincent Tan, you know what PM say? He went to Averton he went to Langkawi. He said bincang. I want you to build a hotel here. His wife pulled him away. [Inaudible] He said Dato Seri I will think about it. The wife pulled him away. There is another [inaudible] cannot get a bank loan. Vincent there. Vincent, can you build a hotel? Ready for next air-show?

I want you do it in 6 months. `Datuk Seri, Don’t worry, I will get it done.’ He paid double the price to get all of them. A big loss lah. Then Solomon Island and Fiji and all, he said, Vincent go and invest there, he went and bought…[inaudible] the government factory [inaudible] you do this project a bit and cover up your loss. PM will do what he want to do to cover your backside.

[Voice off-camera]: Vincent is very close to him.

Lingam: That’s right. Don’t ask… because Vincent has taken me to PM’s residence… the house … [inaudible]… Anwar’s case… the lawyers…Wee Cheong … [inaudible]. But I cannot go and talk to PM just like that and say promote this and that…

Because ah, he knows… I am a… but when PM calls me on Anwar’s case, I can tell him… he’ll listen…But if I go promote so and so, that means I got interest. So, I don’t do that. I use Vincent and Tengku, go and do that. I don’t f*** them up. They go and do that. But I tell you this lah. Don’t tell in front of people, of course. Life, one thing go confidential wrong is dangerous. Ah. Never, never say…You should… never. Even though to PM. You should never say. I don’t know. I always say “I don’t know.” That’s all.

[Voice off-camera]: Everybody… I think many people know.

Lingam: Even the son case, everything I talk the father, …. Talk until he agreed. You know me [inaudible]. But I never talk about it. Even the son’s case, I do everything. I talk to the father…Talk until he agreed. But if it is a big crisis that affects him, ….I can talk, he will listen. But if I want to favour somebody, that I cannot guarantee. Because my interest is not his interest. You know what I mean. Tomorrow invest your interest involving your father, I can come say this this this, you will listen. But tomorrow I appeal for me, you are not obliged to listen. Because you are a politician, PM. Politician is what is your interest, not what is my interest. But if I am giving advice on your interest, you will listen. On my interest, you will not. You must be careful about this.

[Voice off-camera]: Datuk, I need to ask you this question.

Lingam: Ask me. Ask me.

[Voice off-camera]: For a while now…

Lingam: Because we can talk behind these people.

[Voice off-camera]:… Actually, I think, you know, Daim has more equity interest in Berjaya than Vincent Tan, isn’t that true?

Lingam: Let me tell you something … [inaudible] was bought by Daim … [inaudible]. Later on he did some deals where Daim supposed to help him. One or two he helped. Supposed to give him some money. Didn’t give. Part was paid, part not paid. Later on Daim called up and he got paid.


Suwandi didakwa saat-saat akhir untuk batalkan siasatan awam Suhakam?

KUALA TERENGGANU, 13 Dis (Hrkh) - Tindakan pihak Jabatan Peguam Negara, pada saat-saat akhir, mendakwa Suwandi Ab Gani, 38, dan Muhammad Azman Aziz, 21, dua orang yang ditembak seorang anggota polis dengan menggunakan peluru hidup dalam tragedi berdarah Batu Burok, telah menghalang Suhakam untuk meneruskan siasatan awam seperti yang telah dirancangkan.

Sehubungan itu, Pengerusi Panel Siasatan Awam Terhadap Dakwaan Penggunaan Peluru Hidup Semasa Insiden 8 September 2007 di Batu Burok, Dato' Muhammad Shafee Abdullah secara rasmi mengumumkan pembatalan siasatan awam.

Semua sapina yang telah dikeluarkan juga turut dibatalkan.

Muhammad Shafee berkata, tindakan Suhakam mengendalikan siasatan awam itu berdasarkan semata-mata akan fakta bahawa selepas hampir tiga bulan dari kejadian 8 September tersebut, tidak ada mana-mana pihak pun termasuk polis dan Jabatan Peguam Negara yang mengambil tindakan mahkamah terhadap insiden tersebut.

Menurutnya, pada 14 November lalu, Suhakam telah mengadakan satu sidang akhbar mengumumkan keputusan yang dibuat semasa mesyuarat suruhanjaya itu yang ke-93 pada 12 November bahawa satu panel yang terdiri daripada tiga pesuruhjaya akan membuat satu siasatan berkenaan dengan insiden tembakan tersebut.

"Malangnya, dari tarikh tersebut hingga 9 Disember 2007, yakni hampir sebulan, pihak pendakwaan tidak langsung memberi gambaran yang insiden tersebut akan menjadi satu tindakan dalam mahkamah. Pendakwaan terhadap dua orang awam ini, hanya empat hari dibuat sebelum siasatan awam Suhakam dijadualkan berlangsung, dan ia amat mengecewakan,� ujarnya pada sidang media di sebuah hotel di sini, hari ini.

Pesuruhjaya Suhakam, Tan Sri Asiah Abu Samah dan Prof Emeritius Dato' Khoo Kay Kim turut hadir pada majlis yang disertai sama Ahli Dewan Undangan Negeri (Adun) Wakaf Mempelam yang juga Bendahari PAS negeri, Mohd Abdul Wahid Endut dan Ketua Polis Negeri, Dato' Ayub Yaakob.

Muhammad Shafee menambah, Suhakam akan memantau perjalanan perbicaraan yang akan diadakan pada 30 dan 31 Disember ini untuk memastikan perbicaraan tersebut adalah berlandaskan kepada hak-hak asasi manusia.

Suwandi dan Azman kini ditahan di Penjara Terbuka Marang setelah Hakim Mahkamah Sesyen, Hassan Abdul Ghani pada 9 Disember lalu tidak membenarkan mereka diikat jamin.

Mereka menghadapi empat tuduhan, antaranya didakwa menunjukkan kekerasan jenayah untuk menakutkan pegawai polis yang menjalankan tugas yang sah di sisi undang-undang, seorang atau lebih daripada anggota perhimpunan telah dengan sengaja cuba menyebabkan cedera parah kepada Wan Aziz Wan Omar (RF143706), seorang penjawat awam.

Kesalahan itu di bawah Seksyen 149 Kanun Keseksaan dan boleh dihukum di bawah seksyen 333 dan Seksyen 511 kanun yang sama di mana sabit kesalahan boleh dihukum penjara untuk tempoh lima tahun atau denda.

Semua tuduhan itu membabitkan mereka bersama-sama 18 orang yang lain pada 8 September lalu, lebih kurang jam 11.40 malam di tempat letak kereta Hotel Permai Inn, Jalan Sultan Mahmud kerana menyertai perhimpunan yang menyalahi undang-undang.


ISA crackdown: 5 Hindraf leaders arrested

Five leaders of the Hindu Rights Action Force (Hindraf) were arrested by the police this afternoon under the Internal Security Act (ISA), which allows detention without trial.

Inspector-General of Police Musa Hassan said the arrests, under Section 8(1) of the ISA, were made against the five for carrying out activities that threatened national security.

In a rare move, the five were sent straight to the Kamunting detention centre in Taiping, Perak, to be detained for two years, without undergoing the usual 60-day investigation period.

Those arrested are Hindraf legal advisers P Uthayakumar, M Manoharan, R Kenghadharan and V Ganabatirau and organising secretary T Vasantha Kumar.

Musa said that the five were arrested between 12.30pm and 2.30pm in Kuala Lumpur, Petaling Jaya and Seremban.

Kenghadharan was the first to be picked up at his office in Petaling Jaya at around 12.30pm by a police team from from Bukit Aman. Next was Ganabatirau who was nabbed in Seremban. Vasantha Kumar was detained about 2pm in Brickfields, Kuala Lumpur.

According to Ganabatirau's brother Raidu, the lawyer was arrested by a police Special Branch team led by ASP Zairulnain Lamat from Bukit Aman.

“When asked why he was being arrested, he (Zairulnain) said that it was under the ISA,” Raidu told Malaysiakini.

He added that Zairulnain said the police had information that Hindraf was planning another rally like the one organised in Kuala Lumpur on Nov 25.

Meanwhile, Manoharan was arrested near his legal firm in Jalan Pantai, Kuala Lumpur whereas Uthayakumar was the last to be detained at 2.30pm from his legal firm in Bangsar, Kuala Lumpur.

Struggle to continue

Earlier today, Uthayakumar told Malaysiakini that he suspected more Hindraf leaders would be rounded up following Kenghadharan's arrest.

The lawyer also revealed that a police team had followed him from his house to the office and that Ganabatirau was also tailed from Shah Alam to Seremban.

In a related development, Hindraf member S Jayathas said the arrests will not hamper Hindraf’s struggle.

"Regardless of the arrests this struggle will move on. We have many leaders who are waiting to take over and we will not go backwards but move ahead to fight for the rights of Indians in Malaysia," he told AFP.

Under the police radar

The police have been targeting Hindraf lawyers over the past few weeks. The crackdown started with the arrest of chairperson P Waythamoorthy, Uthayakumar and Ganabatirau on Nov 23. They were then charged with sedition in Klang.

On Tuesday, Uthayakumar was again arrested and charged on
another count of sedition in Kuala Lumpur. He was arrested once more on the same day and kept overnight in remand before being released yesterday without being charged.

Both Waythamoorthy and Ganabatirau were also re-arrested over the past week and released after being held for some hours.

Waythamoorthy, who is Uthayakumar's younger brother and also a lawyer, is currently in London on a mission to lobby for support from international groups.

Hindraf has come under the police radar after organising nationwide talks in which they are alleged to have made seditious speeches in relation to the marginalisation of the Indian Malaysian community.

Hindraf's rally in Kuala Lumpur attracted some 30,000 people. The police used water cannon and tear gas to disperse the crowd. Thirty-one of the protesters have been charged with attempted murder and causing mischief with some facing a third charge of illegal assembly.

The government has been threatening to use the ISA against Hindraf leaders for some weeks now.

Last week, Musa claimed that Hindraf was
linked to terrorist groups and was active in fanning racial sentiments among the Indian community by stirring up their anger and arousing hatred against the government.

He added that the police had been monitoring the group - helmed by six prime movers comprising five lawyers and a senior executive of a private company - since July 28.

Law used against gov't critics

The ISA is not thought to have been used against government critics since 2001, when Malaysia was under the iron grip of former premier Dr Mahathir Mohamad who used it to quell a reform movement triggered by the arrest of his deputy Anwar Ibrahim.

Opposition leader Lim Kit Siang condemned the government's move and said that if the Hindraf leaders had committed any offence they should be charged and tried in an open court.

"It is deplorable, the use of the ISA is completely indefensible," he said.

"To resort to detention without trial is a regression to the dark days of human rights violations and is something that will bring further shame to Malaysia's international image and reputation."

Abdullah has for several weeks been threatening to invoke the draconian legislation against Hindraf, which authorities have accused of having links with Sri Lanka's Tamil Tigers. The group denies the charges.

Earlier this week the premier alluded to the use of the ISA by saying that he considered public safety to be more important than public freedom.

Lawyers and human rights group have warned that the use of the ISA will only inflame the protest movement, which is airing grievances that have been bottled up for many years.

Malik Imtiaz Sarwar from the National Human Rights Society (Hakam) said the government's move was regrettable and unnecessary.

"The ISA detention will have the unfortunate effect of now stopping genuine attempts on the part of the marginalised Indian community to have their grievances addressed," he told AFP.

The legislation - which dates back to the British colonial era when it was used against communist insurgents - provides for two-year detention periods that can be renewed indefinitely.
